Florida Public Adjuster FAQ — Recovery-Claim

What does a Florida public adjuster do, and how is that different from my insurance company’s adjuster?

A public adjuster works for you, not the insurance company. We handle inspections, documentation, estimates, and negotiations to help you recover the maximum payout. The adjuster from your insurance company represents their interests, not yours.

How do your fees work? Is it really “no recovery, no fee”?

Yes. We only get paid if we recover money for you. Florida law caps fees at 10% of claim payments for losses during a declared state of emergency (for one year after the event) and 20% otherwise. We cannot charge for money you received before hiring us, or for your deductible.

What kinds of claims do you handle?

We handle new, denied, and underpaid claims for both homes and businesses. This includes hurricane/wind, roof, water and burst pipe, flood, mold, fire and smoke, and business interruption claims.

How fast do I need to file in Florida? What are the deadlines?

You have 1 year from the date of loss to file a new or reopened claim and 18 months for a supplemental claim. For storm events, the “date of loss” is the official NOAA-verified event date.

How long does the insurance company have to pay or deny my claim?

Insurance companies must usually pay or deny within 60 days after notice, unless circumstances beyond their control apply. They must also acknowledge your communication within 7 days, start investigating within 7 days of receiving proof-of-loss, and inspect the property within 30 days.

My claim was denied or underpaid. Can you reopen or supplement it?

Yes, many claims can be reopened or supplemented if additional damage or costs are discovered—within the 1-year and 18-month deadlines.

Should I sign an Assignment of Benefits (AOB)?

No. For property policies issued on or after January 1, 2023, Florida law prohibits AOBs. If you’re asked to sign one, call us first.

My contractor offered to “handle my claim.” Is that allowed?

No. Only a licensed public adjuster or attorney can legally negotiate claims on your behalf in Florida. Contractors cannot act as public adjusters unless licensed.

What is Florida’s “matching” rule?

If repairs would make your property visibly mismatched in quality, color, or size, Florida’s law may require reasonable repairs or replacement in adjoining areas so the finished work looks consistent.

Do you serve my area?

Yes. We serve clients statewide — Miami-Dade, Broward, Palm Beach, Florida Keys, Naples/Fort Myers, Sarasota/Tampa Bay, Orlando/Kissimmee, Jacksonville, Tallahassee, Pensacola, and more.

Will your fee apply to my deductible or money I already received?

No. Fees cannot be based on your deductible or on amounts already paid before you hired us.

What should I do right after damage?

Make sure everyone is safe, prevent further damage (use tarps, stop leaks), take lots of photos and videos, keep receipts, and contact us before signing anything or giving recorded statements.

Do you handle commercial and business interruption claims?

Yes. We handle both residential and commercial property claims, including business interruption losses when covered by your policy.

How does your free inspection and claim review work?

We schedule a free inspection, review your policy, prepare a detailed estimate, and manage the entire claim process from start to finish. No recovery, no fee.

How do I verify your license?

Our Florida firm license is G010162 and our Primary Public Adjuster license is W834533 (Gabriela Herdocia). You can also verify us through the Florida Department of Financial Services online license lookup.

How Do I Know If A Public Adjuster Can Help Me?

Initial-Offer-and-Final-Recovery-Examples-Chart_edited.jpg

If you have an insurable loss or have submitted a claim to your insurance company, a public adjuster could help. If any of the following apply to your claim, please contact us:

  • Have you had an insurance claim in the recent past that didn't go well?

  • Are you going through an insurance claim right now and are wondering if you're getting what you deserve?

  •  Do you feel that you are being treated fairly by the insurance company?

  •  Do you know that you have options to contest your claim and get a larger settlement?

  •  Has your claim been denied, stalled, or low-balled?

  •  Do you want to fight an insurance company's offer because it seems to be final and unfair, but you're not sure how to do it?

If you answered "Yes" to any of these questions, a private, public insurance adjuster may be able to help you get what you deserve.
